West Virginia does not require franchise registration or a state business opportunity filing and does not have generally applicable franchise relationship or termination laws. Franchisors may offer and sell franchises in West Virginia without registering a Franchise Disclosure Document (FDD) with the state.
West Virginia Franchise Law
West Virginia is a non-registration state. Franchisors are not required to register or file an FDD with West Virginia before offering or selling franchises. However, franchisors must comply with the Federal Trade Commission’s Franchise Rule, including providing a current FDD to prospective franchisees at least 14 calendar days before signing any agreement or paying any fees.
