Trademark opposition and cancellation proceedings are filed to prevent a competitor from registering or maintaining registration for a trademark identical or similar to one your business is using.

You are not required to have a trademark registration to pursue your opposition or cancellation proceeding. We can evaluate whether you have grounds for an opposition or cancellation process and navigate you through the process.

Approval, Publication, and Opposition

Once approved by the examiner, your proposed trademark is published in the Official Gazette, which constitutes public notice of your trademark. Any person may oppose the registration if they have grounds. If an opposition is made against the trademark, we will review the claim’s merit and discuss the costs associated with moving forward.
